General Terms and Conditions of Sale (GTCS)

Preamble
These general terms and conditions of sale (GTCS) apply to all service agreements made on the website [https://driver.paris](https://driver.paris). The client acknowledges having read and accepted the GTCS before placing an order. The validation of the order signifies acceptance of the GTCS. Any modifications to the GTCS will be communicated to clients via the website.
Article 1 – General Information
The website [https://driver.paris](https://driver.paris) is a service provided by the company Karline:
Article 2 – Definitions and Description of Activity
  • Seller: refers to the company Karline, providing vehicle rental services with driver via the website https://driver.paris
  • Acheteur : désigne toute personne physique ou morale procédant à l’achat de services de location de véhicules avec chauffeur proposés par le Vendeur.
  • Passager : désigne toute personne physique bénéficiant des services de transport fournis par le Vendeur, suite à une commande passée par l’Acheteur.
Karline propose des services de location de véhicules avec chauffeur.
Article 3 – Quotations, Orders, and Validation
Each service can be reserved in advance and is subject to a quotation. The buyer can make a reservation request via our online form, by email, or by phone. The prices communicated include VAT at a rate of 10% (subject to change according to legislative and/or regulatory provisions). Quotations are valid for 1 day from their issuance. The order is considered final once the client validates the quotation provided by Karline. A booking confirmation is then sent to the client by email, including all details of the service (date, time, pick-up location, etc.). Up to this point, the order can be modified or canceled by the client according to the conditions specified in these GTCS.
Article 4 – Payment Terms
All transport services are payable in advance, unless expressly agreed otherwise in writing. Accepted payment methods include: credit card (via Stripe, a secure platform), bank transfer, or cash on board.
Payments made by the buyer are considered final only after the sums due are effectively cashed by the service provider. Upon written acceptance by Karline, payments can be made in full at the end of the service. For clients recognized as “account clients,” consumed services are invoiced monthly, payable upon receipt, sent at the end of the month of the execution date of the services. An invoice will be provided to the buyer upon simple request. In case of late payment, late penalties will be applied at the legal rate in force, along with a fixed compensation of €40 for recovery costs, in accordance with articles L.441-10 and D.441-5 of the Commercial Code.
Article 5 – Withdrawal and Miscellaneous Fees
The 14-day withdrawal period does not apply to the private chauffeur car rental service. If the order is canceled by the buyer and accepted by the seller, fees will be charged as follows:
  • More than 72 hours before the service: no fee.
  • Between 36 and 72 hours before the service: 25% of the total amount.
  • Between 24 and 36 hours before the service: 50% of the total amount.
  • Less than 24 hours before the service: 100% of the total amount.
If the passenger does not show up at the scheduled pick-up time, the service will be billed in full. Any waiting time not planned during the order and any additional hour not scheduled will be billed without the need for a quotation or validation by the client, in accordance with the acceptance of the GTCS. A grace period of 15 minutes is granted for waiting time, except for airport arrivals where a one-hour grace period is granted from the landing time. Any additional hour started is due.
Article 6 – Warranty and Responsibilities
No commercial warranty is offered beyond the legal warranty. Karline commits to providing services with diligence and professionalism, in compliance with the prevailing standards. However, Karline cannot be held responsible for delays or cancellations caused by circumstances beyond its control (e.g., adverse weather conditions, traffic difficulties, strikes, protests, etc.).
Karline shall not be held liable for indirect damages, such as loss of profit, loss of opportunity, damages, or expenses that may arise from the use of vehicle rental services with a driver. Karline shall not be held responsible for valuables left in the vehicles during the service, damage to materials, or personal items forgotten in the vehicle during the service. In case of a dispute, Karline’s liability will be limited to the amount of the concerned service.
Article 7 – Mediation and Dispute Resolution
In the event of a dispute, the client may refer the matter to a consumer mediator for an amicable resolution. The mediator’s contact details will be provided upon request. For the definition of the competent jurisdiction, the seller elects domicile at 8bis rue Abel, 75012 Paris.
Article 8 – Contract Language and Governing Law
These general terms and conditions of sale are written in French. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute. These general terms and conditions are subject to the application of French law.
This applies to both substantive and procedural rules. In the event of a dispute or claim, the buyer will first contact the seller to seek an amicable solution.
Article 9 – Security and Damage
The driver is required to strictly adhere to the traffic regulations and must not violate the rules (speed limits, one-way streets, failure to yield), even at the request of the passengers, including in cases of extreme urgency.
Any damage to the vehicle’s interior or caused by the passenger will be charged to the buyer. In the event the vehicle is immobilized for repairs requiring more than one day, a minimum fee of €150.00 excluding tax will be charged, depending on the vehicle category. For safety reasons, clients are asked to let the driver open and close the doors.
Smoking is prohibited inside the vehicles, in accordance with the law of September 17, 1977. The driver will stop to allow smokers to relax if necessary. If the client uses narcotics, the driver will immediately stop the service, without any possibility of a refund. Animals are not allowed in our vehicles, except by prior agreement and if a cage or hermetically sealed container is provided.
Article 10 – Confidentiality
The company Karline undertakes to respect the confidentiality of the personal data provided by the client on this website, in accordance with the French Data Protection Act n°78-17 of January 6, 1978. Karline undertakes not to disclose to third parties the personal information provided by the client and to use it only for processing reservations. In accordance with the law, the client has the right to access, rectify, and delete data concerning them. These rights can be exercised by sending a request to Karline’s customer service.
